The Supreme Court of Justice (TSJ) declared null the reform of the statute by which the Parliament, led by the opposition Juan Guaidó, extended its functions for one year, and ordered the Prosecutor's Office to investigate the "criminal type" conduct allegedly committed by the deputies

Through a press release, the highest court -loyal to the administration of Nicolás Maduro- reported on the publication of a sentence that declares “irrita” the reform that, it assures, was emanated from a group of deputies who “usurp” the board of directors Parliament and also simulated a parliamentary session.

The magistrate “Juan José Mendoza Jover, declares any action carried out by the deputies who usurp the functions of the Board of Directors of the National Legislative Organ, with the purpose of perpetuating, extending, continuing or extending the investiture “of deputies, says the text.

The TSJ’s decision came three hours after a group of deputies, who left the ranks of the opposition majority led by Juan Guaidó, filed an appeal against the extension of the current Parliament for one year.

The ruling also indicates that the decision of the current Parliament seeks to “attempt or undermine the installation of the deputies to the National Assembly for the new constitutional period 2021-2026, to begin next January 5, 2021.”

A criminal investigation was requested from the Prosecutor’s Office against the directive and deputies loyal to Juan Guaidó

The sentence adds that ignorance “of an internal or external nature, of an electoral process expressly validated and endorsed by the electoral authority, is an act of force contrary to the legal system”, for which reason it ordered the Prosecutor’s Office to investigate “the alleged materialization criminally. of conducts constitutive of criminal types contemplated in the Constitution and in the law “.

It also ordered the Office of the Comptroller General of the Republic “to evaluate, determine and quantify the material and patrimonial damages caused to the public patrimony, including those that could derive from lost profits, caused by the actions carried out” by the Parliament that is in exercise .

In that sense, it asks the Comptroller’s Office to send “its results to the corresponding bodies, for the determination of the corresponding criminal, civil and administrative responsibilities.”

The current Venezuelan Parliament, which would be replaced next January, approved last Saturday to extend its functions for one year in a virtual parliamentary session in which they agreed to reform the law that governs the transitional statute that they themselves approved in 2019 with the The objective of forcing President Nicolás Maduro to leave power and call presidential elections, both pending tasks.

“Constitutional continuity will be exercised (…) until free presidential and parliamentary elections are held in 2021, an exceptional political event occurs in 2021, or even for an additional annual parliamentary period starting on January 5, 2021 “, says the text promulgated by the House.
