Brazil to tighten rules for digital platforms

This week, Brazil's Supreme Court reached an agreement, by a large majority of its judges, to strengthen the regulations applied to digital platforms, taking into account aspects such as the spread of fake news and hate speech

On Wednesday, June 11, by a majority of its judges, the Brazilian Supreme Court agreed to tighten the rules applying to digital platforms.

The objective of this decision is to regulate activities such as the spread of fake news and hate speech, which are considered crimes under the so-called Internet Civil Framework, in force since 2014.

This framework “establishes that platforms are only liable for damages caused by user posts if they refuse to comply with a court order to remove that content.”

The judges who voted in favor of the measure believe that technology companies in the country are responsible for the content published by users and must “monitor and eventually remove illegal content on their own initiative, without the need for judicial intervention, as dictated by the current regulatory framework.”

According to Judge Flavio Dino, the court is obligated to guarantee the responsible exercise of freedom and “regulated freedom, which is the only true freedom.”
