A federal judge blocked the order issued by US President Donald Trump to eliminate Temporary Protected Status (TPS), which protects more than one million immigrants from Venezuela and Haiti.

The decision by Judge Edward Chen of the Northern District of California was announced last Friday, September 5, sparking a chain reaction on social media, as the measure offers hope to the affected migrants.

Chen “ruled in favor of immigrants affected by the termination of the injunction that protects approximately 600,000 Venezuelans and approximately 500,000 Haitians from deportation.”

The judge “ruled that Secretary of Homeland Security Kristi Noem exceeded her legal authority by terminating the injunction and that her decision was ‘arbitrary and capricious.’” The jurist issued his opinion in a 69-page document, which has been hailed by immigrants as a victory for the National TPS Alliance and “seven Venezuelan immigrants affected by Noem’s cancellation of the injunction ordered last February.”

The ruling will provide protection to two groups of Venezuelans protected by the TPS granted to them by former President Joe Biden (2021-2025): “those granted in 2021, approximately 250,000, and the beneficiaries of the 2023 extension, approximately 350,000.” Likewise, the extension of the protection to half a million Haitians.

It’s possible that the ruling will soon be appealed by the Trump administration, and the case will be referred to the Supreme Court, given that it has already argued “that it has the power to end the benefit and that Chen’s decision should not have national scope.”
