<p style="text-align: justify;">The decree establishes: &#8220;Incorporate as obligated subjects to inform the FIU-Peru, in accordance with the provisions of numeral 3.3 of article 3 of Law No. 29038, the<strong> Virtual Asset Service Providers (PSAV)</strong> that include <strong>any </strong><strong>physical </strong><strong>person or legal entity</strong>, domiciled or incorporated in the country<strong>,</strong> that is not covered in any other of the Recommendations of the <strong>International Financial Action Task Force (GAFI)”.</strong></p>
<p style="text-align: justify;">This means that all companies that <strong>offer: “exchange between virtual assets and fiat or legal tender currencies;</strong> exchange between one or more forms of virtual assets;<strong> transfer of virtual assets;</strong> <strong>custody and/or administration of virtual assets </strong>or instruments that allow control over virtual assets and participation and provision of financial services related to an <strong>issuer&#8217;s offer and/or sale of a virtual asset”.</strong></p>
<p style="text-align: justify;">Exchanges are also required to <strong>implement KYC (customer identification) mechanisms</strong> in order to keep their data on record.</p>

<p style="text-align: justify;">With it, it seeks to guarantee the protection of <strong>the rights of users of the member countries</strong>, as well as to promote innovation, growth and competitiveness of these platforms in the single market.</p>
<p style="text-align: justify;">This regulation also seeks to promote transparency and accountability, which is why it requires online service providers such as <strong>Apple, Twitter or LinkedIn</strong> to publish the number of users they register in Europe.</p>
<p style="text-align: justify;">In this way, it is capable of adapting the specific risk mitigation measures, as stated in its <strong>article 24</strong>, which states that these organizations must update this information &#8220;at least once every six months&#8221; and that it must be public.</p>
<p style="text-align: justify;">For very large online platforms and search engines, ie those with at least<strong> 45 million users</strong>, the Commission requires that a number be provided, not an estimate.</p>
<p style="text-align: justify;">To comply with this regulation, Apple quantified the number of users in the app store for <strong>iOS, iPadOS, macOS, tvOS and watchOS</strong>; as well as those who use their Apple Books and Apple Podcast platforms, in all member countries.</p>

<p style="text-align: justify;">The report data shows that the platform denied the publication in the App Store to more than 343,000 applications for requesting more data from users than was necessary for its operation.</p>
<p style="text-align: justify;">When it comes to fraudulent activity, Apple acted on accounts, reviews, and transfers. In the latter case, its <strong>anti-fraud tool,</strong> which also combines automated systems with human reviews, prevented more than <strong>3.3 million stolen cards</strong> from being used to make purchases and banned nearly <strong>600,000 accounts</strong> from further transactions.</p>
