The objective of this decision is to regulate activities such as the spread of fake news and hate speech, which are considered crimes under the so-called Internet Civil Framework, in force since 2014.

This framework “establishes that platforms are only liable for damages caused by user posts if they refuse to comply with a court order to remove that content.”

The judges who voted in favor of the measure believe that technology companies in the country are responsible for the content published by users and must “monitor and eventually remove illegal content on their own initiative, without the need for judicial intervention, as dictated by the current regulatory framework.”

According to Judge Flavio Dino, the court is obligated to guarantee the responsible exercise of freedom and “regulated freedom, which is the only true freedom.”

In his annual report, traditionally devoted to an issue of relevance to the federal justice system, Roberts provided an analysis of how technologies, including AI, have modernized justice in recent decades. They questioned the future role of human judges, predicting that, although they will continue to be needed, judicial work, especially in trials, will be significantly altered by AI.

Roberts anticipated a change in court operations and underscored the importance of judges understanding the role of this technology in the cases they handle. It also projected increased access to information for lawyers and other participants in the system.

The judge warned about the dangers of using AI, emphasizing the threat to privacy and the potential to dehumanize the law. He referred to recent incidents where an AI tool caused errors, leading lawyers to cite non-existent cases. He urged prudent and humble use of technology.

Despite other burning issues, such as the Supreme Court’s new code of ethics announced a month ago, Roberts focused solely on AI. He mentioned that several committees of the Judicial Conference are investigating the appropriate uses of AI in litigation, among other things.

Despite the controversies that the use of ChatGPT has generated, particularly in judicial processes, the United Kingdom is committed to its good use by the judges of the region, since it is an assistance and not a decision to apply blindly.

In this sense, the Supreme Court, which approved its use at the beginning of this month in the drafting of judicial rulings and other legal rulings, must adhere to the rules included in an official use guide.

A statement from the organization indicates that the use of AI “throughout society is increasing, just as it is happening in the courts.” The procedural guide “details the importance of privacy in judicial processes and, therefore, places special emphasis on the possible problems in this regard that are associated with AI platforms such as ChatGPT.”

Emphasis is placed on the use of chatbots by unscrupulous companies dedicated to collecting information from user interactions. Hence, the need to take care of the privacy of judicial cases. Judges must avoid entering “information into a public AI chatbot that is not in the public domain”; That is, they should not add private or confidential data.

Taking into account that in the case of ChatGPT, any term or search typed will be available later, and could be used as a response to third-party queries, it is essential not to place private case topics in the search bar.

The Supreme Court of the United Kingdom highlights that “some AI platforms, especially those used as an app on a smartphone, tend to request permissions that give access to information within the device. For use in court cases, authorities require that experts refuse permissions and that, in the event of inadvertent disclosure of confidential or private information, they must immediately contact their leading judge and the Judicial Office.”

The Supreme Court will study the laws approved in these two states aimed at restricting social networks “from taking measures against political disinformation”, as the 2024 elections approach.

The laws have sparked controversy from American conservatives and the Supreme Court, who argue that the legal instruments require “special treatment and the jurisprudence on freedom of expression was not necessarily adequate to address this issue.”

The debate focuses on the freedom that platforms such as Facebook, X, Instagram have in terms of content, according to the Computer & Communications Industry Association and NetChoice.

Social networks have taken the place of traditional media, allowing citizens to express themselves, launch protests, and share information. However, “that doesn’t necessarily make them a public forum regulated by the government,” according to Professor Roy S. Gutterman of the Tully Center for Free Expression at Syracuse University.

Representatives of the platforms Facebook and Google have requested that the laws passed in Texas and Florida be repealed, arguing that they conflict with the First Amendment.

At the same time, there are disagreements between conservative and ultra-conservative groups with technology companies, which presumably want to maintain control of social networks.

President Joe Biden, for his part, asked the Supreme Court to take charge of the case, referring to the First Amendment, which guarantees the right to freedom of expression.

However, the government considers inapplicable articles 34 and 36 of the bill, which violate the separation of powers and establish administrative structures within the government.

President Cortizo also argued that the legislation had been approved through an inadequate procedure and had been subject to a partial veto in June 2021, considering that it needed more work to comply with new rules on fiscal transparency and the prevention of money laundering.

The dispute over the regulation of cryptocurrencies in Panama has been a hot topic between Congress and the government. In April 2022, Panamanian legislators approved a proposal to regulate cryptocurrencies, including Bitcoin, but President Cortizo warned that he would not sign it unless it included additional rules against money laundering.

The bill was introduced in September 2021 with the goal of making the country fit for the digital economy and would regulate the use of crypto assets as a payment alternative, the tokenization of precious metals, and the issuance of digital securities. In addition, it would explore the digitization of identity through blockchain.

The decision of the Supreme Court will be crucial for the future of the crypto industry in Panama and will determine if the legislation is applied or declared inapplicable.

The request, signed by the deputy attorney general, Humberto Jacques de Medeiros, has been sent to Judge Carmen Lucia Antunes, a member of the Supreme Court, to denounce the alleged irregularities committed by Bolsonaro’s minister and other officials.

The Supreme Court, which is already investigating Salle on suspicion of facilitating the illegal export of wood, has received this request made based on a demand from the Federal Police in Amazonas in April, reports the Brazilian media G1.

Specifically, the former head of this Police department, Alexandre Saraiva, has advocated for the minister’s investigation, alluding to the fact that he halted inspection measures in the event of damage to the environment and hindered the investigation of the largest seizure of wood in history.

In the request, the PGR has requested authorization to obtain testimony from Salles, testimonies from rural owners and inspection agents, and a scanned copy of all inspection and investigation procedures related to environmental crimes.

The Supreme Court judge Alexandre de Moraes authorized the ‘Akuanduba’ operation, which began in January, in which the minister and other senior officials and businessmen are being investigated in an irregular plot in the timber export. Thus, if the Supreme Court also authorizes this request from the PGR, Salles will face a second investigation.
