It has been just eight months since the SEC authorized bitcoin spot ETFs and other managers are still waiting for their applications to be approved by the agency.

It is important to remember that in January, the New York-based asset manager received approval to “launch iShares Bitcoin Trust ETF (IBIT), an exchange-traded product that offers investors direct exposure to bitcoin. The fund received approval along with nine other proposals, including from Fidelity, Ark Invest and Grayscale.”

BlackRock’s next strategic step was to seek to “list and trade IBIT options on the local market,” just as Grayscale and Bitwise, among others, have proposed “listing and trading options for their respective spot Bitcoin ETFs. Although these applications are still awaiting SEC approval.”

The SEC reported on Friday, September 20 in a filing the approval of BlackRock’s proposal on an “accelerated” basis. However, it clarified that it is simply an approval stage, since it still needs to be approved by the OCC (Office of the Comptroller of the Currency) and the CFTC (Commodity Futures Trading Commission), so that it can then be official.

In this sense, on Thursday it was announced that the charges against the company’s CEO, Brad Garlinghouse, and against the executive president, Chris Larsen, were withdrawn to move to a phase of negotiations “respectfully” requested from the regulatory body.

The document presented indicates that both parties reached an agreement “to voluntarily and with prejudice dismiss the complicity charges filed against these two executives, which implies that said charges cannot be reinstated in the future.”

The SEC, however, “will continue its legal claims against Ripple, keeping the ongoing legal dispute alive.”

It is unknown how these developments, in addition to regulatory and legal aspects, could impact Ripple’s cryptocurrency, XRP. For now, the parties agreed to establish information sessions, protected by the “spirit of cooperation,” which has led to the extension of the deadline until November 9 to submit to the court “a calendar proposal” for said meetings. If an agreement is not reached, the court must intervene and set a meeting agenda beneficial to both parties.

The legal situation has continued for three years, during which time both Garlinghouse and Larsen have been under accusations by the SEC that are considered “baseless” and politically flawed.

The SEC has taken this action to protect client assets, as it alleges that Binance has been engaged in illicit conduct for several years, defying US laws, evading regulatory oversight, and raising questions about financial transfers and custody of assets. customer assets.

Under the order, Binance and its co-founder and CEO Changpeng Zhao have to hand over possession, custody, and control of client assets within five days.

In addition, Binance has been requested to transfer client assets to new electronic wallets with new private keys, including administrative keys, and to provide the SEC with a registry of all new electronic wallets with client assets.

This comes just one day after the SEC filed a lawsuit against Binance, accusing the company of operating illegally in the United States and exposing investors to significant risk.

Additionally, today the SEC also sued Coinbase, another cryptocurrency platform, accusing it of operating as an unregistered stock exchange and stockbroker.

The regulatory body has revealed the forthcoming opening of the Industrial Applications and Services office and the Cryptoactive Office. These are two entities that will address the life sciences and cryptocurrencies sectors.

The Disclosure Review Program currently has several corporate offices, to which will be added those recently announced by the SEC, in order to provide specialized support in sectors that demonstrate permanent and accelerated growth.

SEC DRP Director Renee Jones said that “the creation of these new offices will allow DRP to enhance its focus in the areas of crypto assets, financial institutions, life sciences, and industrial applications and services and will facilitate our ability to fulfill our mission.”

With the creation of the new office on crypto assets, the regulatory body in the United States strengthens its commitment to the legal framework of digital currencies, as the president of the SEC, Garry Gresler, has assured in various statements.

After the legal conflict that Ripple is going through due to the lawsuit of the US Securities and Exchange Commission (SEC), Uphold’s position will remain favorable to the cryptocurrency XRP.

The cryptocurrency exchange operator and payment processor, Uphold, assures that until there is a legal justification from the Court on the charges of the SEC, it will not eliminate the digital asset, much less suspend its trading.

The company’s CEO, J.P. Thieriot, confirmed his position in a message posted on his Twitter account where he assures that Uphold “has decided to continue listing XRP unless the SEC complaint against Ripple is adjudicated to legally determine that XRP is currently a security or until the volume trading dissipates to a point where we can no longer support XRP. “

In addition, the company expressed the need to wait for a final judgment from the Court instead of making hasty and unjustified conclusions; therefore, he hopes other exchanges will take a similar stance on the matter rather than “go to trial before the court’s decision.”

For the exchange, the SEC’s decision could generate huge losses, leaving consumers without protection, “it is difficult to see how a lawsuit that makes XRP essentially useless and could make retail investors lose billions of dollars. who bought XRP in good faith would fit that mandate. We are still waiting for a sensible resolution, “Uphold said.
