<p style="text-align: justify;">To comply with the requirements of the <strong>Digital Services Law and the Digital Markets Law,</strong> Meta has modified the minimum age to open an account on WhatsApp. <strong>Those under the limit,</strong> established at 13 years old, could <strong>lose their account.</strong></p>
<p style="text-align: justify;">The measure is already explicit in the <strong>Help Center,</strong> where it reads: &#8220;The minimum age in the European Region will be modified from 16 to 13 years.&#8221; This favors the <strong>connection of minors with their family and friends,</strong> which is seen as a positive development.</p>
<p style="text-align: justify;">The measure is applied practically in parallel to the <strong>interoperability</strong> of WhatsApp with platforms such as <strong>Telegram, Signal or iMessage</strong> without having to leave the Meta application, maintaining end-to-end encryption in conversations.</p>

<p style="text-align: justify;">It is &#8220;dsdl&#8221; that is, a directory services identifier, which classifies each <strong>iCloud</strong> account and associates it with a specific user. In this sense, the developers have pointed out that <strong>Apple collects</strong> information from iPhone owners despite the fact that its privacy statement indicates otherwise.</p>

<p style="text-align: justify;">The origin of this complaint dates back to <strong>2010,</strong> when the FTC filed a lawsuit against Twitter for not guaranteeing users the <strong>privacy of their data</strong>.</p>
<p style="text-align: justify;">So, the company promised its users that only they could control who had access to their posts and that only the <strong>final recipients</strong> of the private messages could access the information transmitted through this medium.</p>
<p style="text-align: justify;">However, Twitter did not have the power to <strong>guarantee compliance with this privacy</strong>, since the <strong>FTC</strong> exposed a series of cases in which the social network had accessed the personal information of users without their consent.</p>
<p style="text-align: justify;">To solve this problem, the social network agreed to comply with an order imposed by this commission, which <strong>became official in 2011,</strong> in which it was determined that the FTC would impose substantial financial fines if it again manipulated the measures intended to protect the security of the users.</p>

<p style="text-align: justify;">According to a resolution published in the country&#8217;s <strong>Official Gazette,</strong> the Executive decided to maintain the ban implemented in <strong>May 2021</strong> until an ongoing investigation for alleged &#8220;abuse of dominant position&#8221; by the messaging firm is concluded.</p>
<p style="text-align: justify;">The Government indicated in May of last year that the messaging platform and its parent Facebook incurred in a &#8220;situation of abuse of a dominant position&#8221;, since &#8220;there is empirical evidence that the worldwide demand for the WhatsApp Messenger application, with more of <strong>2,000 million users</strong>, it far exceeds platforms such as Telegram&#8221;.</p>
<p style="text-align: justify;">In this sense, the Administration of <strong>Alberto Fernández</strong> argues that the application seeks with its update to generate &#8220;metadata to profile users/buyers, that is, to generate an asset that is difficult to replicate by potential competitors or, in other words, to generate entry barriers in the online advertising market, all in probable violation of the competition defense regime&#8221;.</p>
<p style="text-align: justify;">&#8220;Updating the service conditions and privacy policy of <strong>WhatsApp Messenger</strong> would strengthen the position of <strong>Grupo Meta</strong> in the <strong>online advertising market,</strong> making it possible to obtain new data or, at least, to maintain an excessive or unjustified level of collection&#8221;, highlights the text published today by the Government.</p>
<p style="text-align: justify;">The <strong>resolution orders</strong> the messaging firm and Meta to communicate to WhatsApp Messenger users, through the application or through the <strong>official website,</strong> the full text of the measure in <strong>Argentina.</strong></p>

This date users will not lose the account in the <strong>messaging service</strong> if they do not accept new policies but will face some restrictions concerning its functions.</p>
<p style="text-align: justify;">The company will begin to show the message again about the changes it will make with the new policies, focusing on the data that WhatsApp collects from users and <strong>their treatment,</strong> as well as the way in which businesses can use <strong>Facebook&#8217;s</strong> <strong>hosted</strong> services to <strong>store</strong> and <strong>manage their chats.</strong></p>
<p style="text-align: justify;">Users must accept the changes before they come into force, on <strong>May 15,</strong> a requirement to be able to continue using WhatsApp fully, but whose rejection does not mean the loss of the account, as indicated by the company in the official blog.</p>
<p style="text-align: justify;">However, users will not have &#8220;<strong>access to all the functions of WhatsApp until they accept the policies</strong>&#8220;, as they explain. This means that, for &#8220;a short time&#8221;, they will be able to <strong>receive calls</strong> and <strong>notifications,</strong> but they will not be able to read or send messages from the application.</p>
<p style="text-align: justify;">The company remembers in its blog that users can accept the new policies &#8220;even after May 15&#8221;, and in this case, it will apply the<strong> related policy</strong> regarding &#8220;inactive users&#8221;. It also notes that users <strong>can export chat history</strong> and download a report from their account, or ultimately delete the account.</p>

<p style="text-align: justify;">In the same message that warned that in order to continue using the service, users had to accept the changes.</p>
<p style="text-align: justify;">The <a href="https://www.whatsapp.com/legal/updates/privacy-policy/?lang=es" target="_blank" rel="noopener">new policies</a> do not imply material changes in the processing of data for users in the <strong>European Union,</strong> and that WhatsApp does not yet share the data of those users with Facebook in order for the parent company to use it to <strong>improve products</strong> and advertisements.</p>

<p style="text-align: justify;">However, thanks to the confusion generated, the company decided to postpone the date on which these changes will come into effect (initially on February 8), without this <strong>change involving</strong> suspensions or eliminations of accounts among those who until now had not accepted the <strong>informational message</strong>, as explained in a statement.</p>
<p style="text-align: justify;">WhatsApp also indicates that they will take &#8220;a series of measures to clear up the <strong>misinformation regarding</strong> the way privacy and security work.&#8221; Subsequently, and gradually, users will have to review the policy, &#8220;at their own pace&#8221;, before the new options for companies take effect on <strong>May 15.</strong></p>
