The social network X was reactivated in Brazil, by order of Magistrate Alexandre de Moraes, after the company owned by Elon Musk paid a fine of $5.2 million.

The Supreme Court of Brazil authorized on Tuesday, October 8, the “immediate” unblocking of the platform on the condition that it complies with Brazilian court rulings and regulations.

Judge Alexandre de Moraes made the request to reinstate the social network X to the National Telecommunications Agency, and pointed out the condition imposed on the company to comply with internal Brazilian regulations, in addition to complying with “judicial decisions on the elimination of profiles accused of spreading fake news.”

It is important to remember that for weeks, after the suspension of X in August, Musk “refused to comply with orders to delete profiles and, after receiving an ultimatum from De Moraes, announced that he was closing the social network’s office in Brazil and that he was relinquishing legal representation in the country, despite the requirements of Brazilian law.”

In September, Musk adopted a more flexible attitude, backing off his provocations. In this sense, “he again appointed legal representatives in the country and agreed to comply with court orders on the elimination of profiles.”

The bank accounts of Starlink and social network X, owned by Elon Musk, were unblocked in Brazil after paying a fine of 18.35 million reais; that is, about $3.3 million.

The fine that Musk has had to pay stems from the litigation for the social network’s failure to comply with the order issued by Judge Alexandre de Moraes to block accounts in the country that, according to the authority, promoted disinformation and spread hate messages.

However, the Bar Association challenged the decision of the Supreme Court. The Brazilian Attorney General’s Office argued on September 12 that the ban on social network X in Brazil does not violate the right to freedom of expression.

The PGR also declared that the lawsuits against the ban on X in Brazil lack legal grounds, so the suspension remains in place in the country.
