The Supreme Court of Justice (TSJ) of Venezuela has suspended “for all purposes” the primary process organized by the opposition and from which former deputy María Corina Machado emerged the winner, on the grounds that several crimes could have been committed in the organization of a vote that did not have the endorsement or supervision of the official party authorities.

The electoral chamber of the TSJ has ruled following a complaint filed by deputy José Brito, which attributed “unconstitutional and illegal acts” to the National Primary Commission, the body created ‘ex professo’ for this vote. The judges admit the request for precautionary protection, which implies the paralysis of “the different phases of the electoral process” of the opposition.

In this sense, they have required the Commission to present a series of documents, among them the minutes relating to Machado, of whom they recall that she is a “citizen who has been firmly disqualified for 15 years”, which theoretically prevents her from occupying public office, as well as other equally disqualified candidates such as Henrique Capriles and Freddy Superlano, although both withdrew from the process before the final vote.

According to the ruling of the TSJ, “the minutes of the event held on October 22, 2023, must also be recorded, including the Minutes of Constitution of the Electoral Tables, the Voting Notebooks, the Voting Ballots, the Minutes of Scrutinies, as well as the Regional Totalization Acts, the Final Totalization Act, the Adjudication Act and the Proclamation Act.”

The Electoral Chamber of the organization has given a period of three days for the delivery of all the requested documents counted from its notification.

Likewise, the TSJ has ordered that the decision be notified to the attorney general, Tarek William Saab, “in view of the multiple and serious complaints related to that electoral event,” since part of the facts may involve “the alleged commission of crimes against the Constitution of the Bolivarian Republic of Venezuela, the alleged commission of electoral crimes and the alleged commission of common crimes,” reads the sentence released this Monday.
