<p style="text-align: justify;">The announcement was made on Friday, September 6, detailing the resolution of the <strong>National Directorate of Migration (DNM</strong>), published in the Official Gazette, and which will be <strong>valid for a renewable period of 90 days.</strong></p>
<p style="text-align: justify;">“Children <strong>under 9 years of age who do not have a Venezuelan identity card or passport</strong> may exceptionally enter with a <strong>birth certificate,</strong>” the Argentine authorities have indicated, adding that in the event that Venezuelan migrants “do not have any of the documents, Identity may be proven by means of a<strong> sworn statement</strong> as long as the person has<strong> entered the country regularly and is registered in the migration database.”</strong></p>
<p style="text-align: justify;">On the other hand, the measure will help <strong>correct the immigration gap that has affected more than 10,000 Venezuelans during the government of Alberto Fernández</strong>, after resolution 520 of 2019, promulgated by the government of Mauricio Macri, was repealed, “which had made the entry and filing requirements more flexible.”</p>

<p style="text-align: justify;">As established in article 1 of the aforementioned decree, both the President and the other members that make up the Sunacrip Restructuring Commission will continue to perform their respective functions until the end of this <strong>extension.</strong></p>
<p style="text-align: justify;">The restructuring of Sunacrip was ordered by the president of Venezuela, <strong>Nicolás Maduro,</strong> in March 2023.</p>
<p style="text-align: justify;">The board in charge of carrying out this restructuring process is headed by <strong>Anabel Pereira Fernández</strong> and has the participation of other main directors, namely: Héctor Andrés Obregón Pérez, Julio César Mora Sánchez, Román Daniel Maniglia Darwich and Larry Daniel Davoe Márquez.</p>
<p style="text-align: justify;">The substitute directors are <strong>Luis Alberto Pérez González,</strong> Pavel Javier García Sandoval, <strong>Carlos Eloy Pirela Méndez</strong> and Edgardo Alfonzo Toro Carreño.</p>
<p style="text-align: justify;">Among the responsibilities of the Sunacrip restructuring board are to exercise all functions and activities related to the restructuring process of the <strong>National Superintendency of Cryptoassets and Related Activities</strong> (Sunacrip), develop the <strong>institution&#8217;s Restructuring Plan,</strong> and implement said plan addressing all organizational, functional and operational aspects of Sunacrip, establishing guidelines for its improvement, reorientation or correction, as appropriate.</p>

<p style="text-align: justify;">The approved legislation provides for the delivery of <strong>licenses </strong>to <strong>natural</strong> or <strong>legal persons</strong> who wish to operate services with bitcoin and virtual assets as a business. Said law will enter into force as of May 16 of this year.</p>
<p style="text-align: justify;">Cuba has historically been characterized by its restrictive policies on the economic and financial sector. However, with the approval of this new law, the Caribbean island &#8220;takes another step forward to <strong>adopt Bitcoin and its industry</strong>.&#8221;</p>
<p style="text-align: justify;">On the other hand, the new legislation will allow local and foreign companies to emerge to operate with cryptocurrencies and offer their services in the country.</p>
<h2 style="text-align: justify;">Central bank responsible for granting licenses</h2>
<p style="text-align: justify;">In accordance with the provisions of the Official Gazette, the Central Bank will be the only body authorized to <strong>grant licenses,</strong> both to natural and legal persons, who wish to operate services with <strong>Bitcoin and virtual assets.</strong></p>
<p style="text-align: justify;">Likewise, it indicates that the financial entity before granting the license must evaluate “the legality, opportunity and socioeconomic interest of the initiative, the characteristics of the project, the responsibility of the applicants and their experience in the activity. The Central Bank of Cuba issues the license, after consulting the <strong>Cryptoactive Group”.</strong></p>
<p style="text-align: justify;">Due to the novelty and experimental nature of these activities, the licenses granted will last for one year, extendable for a second year. The law also establishes that “<strong>virtual asset service</strong> providers cannot cease their operations without authorization from the Bank.”</p>

										<content:encoded><![CDATA[<div style="margin-bottom:20px;"></div><p style="text-align: justify;">This week <strong>Official Gazette No. 6,691</strong> was published, which establishes the validity of the minimum wage as of <strong>March 15, 2022.</strong></p>
<p style="text-align: justify;">According to part of the text, specifically in article 1, &#8220;the mandatory monthly national minimum wage is increased throughout the territory of the <strong>Bolivarian Republic of Venezuela</strong>, for workers in the public and private sectors, without prejudice to the provisions in article 2 of this Decree, as of March 15, 2022, establishing the amount <strong>one hundred and</strong> <strong>thirty bolivars (Bs. 130.00) per month.&#8221;</strong></p>
<p style="text-align: justify;">On the other hand, section 4 establishes that this increase has a direct effect on the amount of state pensions, as it does for retirees from the <strong>Venezuelan Public Administration.</strong></p>
<p style="text-align: justify;">As an important point, it should be noted that the <strong>Official Gazette</strong> does not mention in any of its articles that the minimum wage is <strong>anchored to the Petro</strong>, as President <strong>Nicolás Maduro</strong> announced at the time.</p>
<p style="text-align: justify;">This new salary increase is equivalent to approximately <strong>30 dollars</strong> according to the dollar rate of the <strong>Central Bank of Venezuela (BCV)</strong>. The percentage increase in the minimum wage is 1,757.14 % compared to the previous one in Venezuela, which stood at <strong>7 bolívares</strong>.</p>

<p style="text-align: justify;">In this way, people who use their debit or credit cards from accounts in any country in the world will not have to pay the <strong>3 % tax per transaction</strong>, as reflected in the reform of the Tax Law on Large Financial Transactions (<strong>IGTF</strong>).</p>
<p style="text-align: justify;">It should be noted that the tax exemption will only apply to those who make payments in bolivars and through duly authorized payment points. That is, some points of sale that are used informally in some businesses and that make the direct payment in dollars are excluded. .</p>
<p style="text-align: justify;">Likewise, it was learned that transactions made with <strong>debit cards</strong> charged to <strong>accounts in dollars or euros</strong> of the national bank will be exempt from the new tax, according to article 5 of the decree.</p>

<p style="text-align: justify;">Recently, Resolution No. 001.21, which dictates the &#8220;<strong>Norms that Regulate Financial Technology Services </strong>(Fintech)&#8221;, was published in the Official Gazette N ° 42,151, dated June 17, 2021, a series of norms that seeks to guarantee a system banking with <strong>modern and quality services</strong>.</p>
<p style="text-align: justify;">The aforementioned resolution aims to regulate financial services provided through new technologies, offered by <strong>Financial Technology Institutions</strong> (Fintech), which are aimed at providing financial solutions promoted by technology, which involves all those financial services companies that use <strong>Advanced technological processes</strong> and systems to be able to offer innovative products and services under <strong>business models.</strong></p>
<p style="text-align: justify;">These regulations promote the principles of <strong>financial inclusion, promotion of competition,</strong> protection of the banking user, preservation of financial stability, prevention of <strong>money laundering </strong>operations, financing of<strong> terrorism </strong>and financing of the proliferation of weapons of mass destruction.</p>
<p style="text-align: justify;">Faced with this situation, Sudeban urged all public and private entities to comply with the regulations within a period of no more than <strong>90 days</strong>. Within this period they must request the<strong> authorization and permits</strong> that are necessary from the body.</p>

<h2 style="text-align: justify;">Bitcoin legislation, a pioneering initiative</h2>
<p style="text-align: justify;">Part of <strong>article 1</strong> of the <strong>new regulations</strong> approved and called the <strong>Bitcoin Law</strong> states: &#8220;This law is intended to regulate bitcoin as legal tender, unrestricted with liberating power, unlimited in any transaction&#8221; and to any title that natural persons, public or private legal requirements to be carried out.</p>
<p style="text-align: justify;">The ordinance establishes that the <strong>exchange</strong> between <strong>virtual currency and the dollar</strong> will be established <strong>&#8220;freely by the market&#8221;</strong> and will not be subject to capital gains taxes like any legal tender.</p>
<p style="text-align: justify;">In addition, the law indicates that <strong>every economic agent must accept digital currency</strong> as a form of payment when it is offered by whoever acquires a good or service and that the government will implement the necessary<strong> institutional structure</strong> for the circulation of <strong>cryptocurrency.</strong></p>
