<p style="text-align: justify;">It is estimated that next year, the current <strong>Legal Monthly Minimum Wage (SMMLV in Spanish)</strong> will rise &#8220;to double digits, reaching almost <strong>3 million pesos with contributions,</strong>&#8221; despite &#8220;alarming business projections regarding<strong> total labor costs.&#8221;</strong></p>
<p style="text-align: justify;">The base figure is projected to be<strong> around 1.6 million pesos</strong>. Internally, estimates of the <strong>real cost of a worker to the employer are around 3 million pesos.</strong></p>
<p style="text-align: justify;">The Ministry of Labor has proposed an 11 % increase. “This proposal aims to<strong> restore workers&#8217; purchasing power,</strong> significantly exceeding inflation projections for the end of the adjustment cycle.”</p>
<p style="text-align: justify;">With this increase, the<strong> minimum wage would rise from $1,423,500 to $1,580,085; the transportation allowance would increase from $200,000 to $222,000, bringing the total amount received by workers from $1,623,500 to $1,802,085.</strong></p>
<p style="text-align: justify;">However, if e<strong>mployer contributions to pension and health insurance, social benefits (bonuses, severance pay, and vacation pay), and parafiscal contributions (</strong>Compensation Funds) are included, the <strong>total employer burden would be approximately between $2,730,000 and $2,800,499 COP, which is double the net minimum wage.</strong></p>
<p style="text-align: justify;">The deadline for an agreement from the tripartite committee is <strong>December 15.</strong> If no agreement is reached by then, the <strong>National Government will have until December 30 to decree the increase on its own.</strong></p>

<p style="text-align: justify;"><strong>If the decree is approved, the minimum wage must follow the principles of the European Social Charter, always remaining at 60 % of the average wage.</strong> The regulation clearly states that &#8220;the calculation of the minimum wage will be based solely on monetary remuneration, excluding wages in kind.&#8221;</p>

<p style="text-align: justify;">Although the law <strong>must be introduced in March to the Congress of Deputies</strong> for voting, it is expected to come into force before the summer. Important previous steps are required before it is <strong>fully applied.</strong> In this sense, <strong>companies will have until December of this year to adapt to the new schedule.</strong></p>
<p style="text-align: justify;">The application of the law requires a<strong> reformulation of the control of hours</strong>, adoption of <strong>digital systems for employee registration</strong> by companies and <strong>real-time inspection methods by the Labor Inspectorate.</strong></p>
<p style="text-align: justify;">In case of <strong>non-compliance</strong> with the registration of hours and the reduction of the working day as specified, companies will receive a <strong>fine of 10,000 euros per worker.</strong></p>
<p style="text-align: justify;">Part-time contracts with an average working day equal to or greater than 37.5 hours per week, “will become full-time employment contracts from the application of the new legal working day.”</p>

<p style="text-align: justify;">The proposal specifies that both teleworkers and face-to-face employees must have the<strong> same rights and obligations,</strong> which is why within the project it is established that their performance will be measured under the same standards.</p>
<p style="text-align: justify;">It is also attributed that they will have the opportunity to opt for promotions or changes of modality as long as their performance, experience and preparation make them eligible for it.</p>
<p style="text-align: justify;">The intention expressed by Villegas is to establish <strong>equal pay</strong> in different areas and for this the legislator said that he has held meetings with the representative of the Ministry of Labor, <strong>Luis Miguel DeCamps</strong>, in order to unify criteria and points of view with the institution that regulates labor issues in the country.</p>
<p style="text-align: justify;">In this sense, the legislator stated that within the project, <strong>remuneration</strong> is established for <strong>employees</strong> for the <strong>use of their personal tools</strong>, such as the <strong>Internet, electricity and local telephone.</strong></p>
