<p style="text-align: justify;">One of the main aspects of this forum was the proposal to create <strong>ANGAM</strong> “as<strong> an autonomous institute” responsible for “managing and administering mining rights, coordinating the Public Mining Registry and the National Mining Cadastre,</strong> and clearly separating the <strong>regulatory (Agency) and oversight (Ministry) functions,</strong> eliminating the current conflict of interest and discretionary power.”</p>
<p style="text-align: justify;">The speakers agreed that <strong>“the Venezuelan mining model must shift from a one-off contractual approach to a systemic model that involves a profound transformation of public policy.”</strong> Barboza emphasized the need to apply <strong>“international standards such as ESG (Environmental, Social, and Governance) and UNFC 2019.”</strong></p>
<p style="text-align: justify;">The experts addressed <strong>other aspects to consider, such as legal security and regional competitiveness, sustainability and combating illegal activity,</strong> and the economic potential of mining for the country. All these issues, carefully managed, <strong>could generate between $6 billion and $10 billion in revenue to boost the country&#8217;s development.</strong></p>

<p style="text-align: justify;">Regarding the role of banks before cryptocurrencies, he stated: “The <strong>banking sector is a crucial ally. It acts as a ‘railway’ or gateway for cash-in and cash-out transactions.</strong> Although banking institutions cannot perform direct exchanges, they allow exchange houses to carry out instant transactions.”</p>
<p style="text-align: justify;">Garrido noted that in Venezuela, the <strong>trading of digital assets has a clear legal framework, recalling that the National Superintendency of Cryptoassets and Related Activities (Sunacrip in Spanish)</strong> has been the entity responsible for regulating the sector since 2023. “The <strong>legality</strong> of using cryptocurrencies is established in <strong>the 2019 Constituent Decree, and BA VEN-NIF 12 regulates the accounting records of digital assets,”</strong> he added.</p>

<p style="text-align: justify;">With this decision, the judicial body shows a shift towards a progressive change with respect to cryptocurrencies in the<strong> United Arab Emirates,</strong> where until 2023 they were considered to lack a precise valuation.</p>
<p style="text-align: justify;">This was stated by Irina Heaver, partner at the United Arab Emirates law firm NeosLegal, who referred to “the ruling in <strong>case number 1739 of 2024”</strong> in comparison to the situation a year ago.</p>
<p style="text-align: justify;">According to Heaver, in the case <strong>an employee had filed a lawsuit</strong> “alleging that the employer had not paid his wages, wrongful dismissal compensation and other benefits. The worker&#8217;s employment <strong>contract stipulated a monthly salary in fiat and 5,250 in EcoWatt tokens.</strong> “The litigation has its origins in the employer’s inability to pay the token portion of the employee’s salary within six months.”</p>
<p style="text-align: justify;">In reference to the litigation, it is important to note that last year the court recognized the inclusion of EcoWatts tokens in the contract. However, it was indicated that the <strong>payment was not made</strong> <strong>in cryptocurrencies</strong> since the worker <strong>“did not provide a clear method to value the currency in fiduciary terms.”</strong></p>
<h3 style="text-align: justify;">Inclusive salary approach on the path to the digital economy</h3>
<p style="text-align: justify;">Heaver clarified that<strong> in 2024, the court ordered the payment of the crypto salary</strong> according to the<strong> employment contract</strong> without converting it into fiat. “This decision reflects broader acceptance of cryptocurrencies in employment contracts and highlights the court&#8217;s recognition of the <strong>evolving nature of financial transactions within the Web3 economy.”</strong></p>
<p style="text-align: justify;">The lawyer also stressed that the court&#8217;s reliance on the <strong>UAE Civil Transactions Law and Federal Decree-Law No. 33 of 2021</strong> in the two rulings is an example of the consistent application of legal principles in determining salaries.</p>
<p style="text-align: justify;">With this precedent, it is possible to foresee an<strong> increase in the adoption of digital assets in everyday financial transactions in the UAE,</strong> with a more inclusive and innovative salary approach, strengthening the legitimate right of employees to pay their income in fiat or cryptocurrencies, according to the current legal framework.</p>

It is expected, if approved, that it provide a legal foundation for both citizens and investors in the <strong>crypto ecosystem.</strong></p>
<p style="text-align: justify;">With the bill, greater clarity is expected regarding the management of crypto assets, digital mining, as well as &#8220;providing a legal framework for their legal issuance and circulation in Russia, certifications, trade, and more.&#8221;</p>
<p style="text-align: justify;">Another aspect addressed in the document is related to the permission of the actors that will participate in the system and establishes that &#8220;<strong>Russian entities will have to receive a permit to trade with cryptocurrencie</strong>s and must comply with a rigorous and strict <strong>identification process&#8221;</strong>. Within The aspects to consider include: the creation of separate units, annual reports, internal control, audits, and complete records in specialized entities for the fight against money laundering.”</p>
<h2 style="text-align: justify;">Platforms with minimum capital</h2>
<p style="text-align: justify;">The bill also highlights that <strong>cryptocurrency platforms</strong> will have to meet a minimum <strong>capital to offer their services in Russia</strong>. The amount established in the document is in the order of &#8220;40,000 dollars for exchange operators and more than 100,000 dollars for digital trading platforms.&#8221;</p>
<p style="text-align: justify;">Another of the requirements established in the documents for exchange houses is to complete the registration process and obtain a <strong>license</strong> that will be granted by the “authorized body”, which will be designated by the government for that purpose. Additionally, the exchanges must keep a &#8220;<strong>strict control</strong>&#8221; of all the data of each of the clients that demand cryptographic assets.</p>
<p style="text-align: justify;">Like any bill, it has its detractors. Some analysts are already sharing their impressions, some believe that the project is &#8220;<strong>useless</strong>&#8221; and the procedures quite &#8220;cumbersome&#8221;, especially for small and medium-sized companies.</p>
<p style="text-align: justify;">According to the document, it is not possible to &#8220;sell or buy <strong>digital currencies</strong>&#8221; without taking into account the identification, and it will only be possible to &#8220;deposit and withdraw fiduciary currencies through banks through a <strong>bank account&#8221;.</strong></p>
<p style="text-align: justify;">The regulation of the use of <strong>cryptocurrencies in Russia</strong> can be a very good sign to establish a legal foundation for the cryptographic system in the country, but it is also important to listen to criticism in order to improve the final document.</p>

<p style="text-align: justify;">Minh Khai specifically entrusted the <strong>Ministry of Finance</strong> with the primary responsibility for reaching agreement with other regulators and the central bank to <strong>identify specific</strong> laws that need to be amended, supplemented and enacted, as well as recommending a specific time frame for implementation.</p>
<p style="text-align: justify;">Everything related to this law will be worked according to <strong>&#8220;Decision 1255&#8221;,</strong> which was issued in <strong>August 2017</strong> and which contemplates the approval of a plan to create a series of laws for the management and handling of digital assets.</p>
<p style="text-align: justify;">Some proposals to regulate cryptocurrencies were put forward in <strong>November 2018,</strong> but no decision was made. As we said, there was no <strong>concerted decision</strong> and important sectors were betting on the ban.</p>

										<content:encoded><![CDATA[<div style="margin-bottom:20px;"></div><p style="text-align: justify;">The <strong>Government of Spain</strong> is working on a way to cover all the legal voids in cryptocurrencies, this is how the <strong>Extraordinary Council of Ministers</strong> approved a reform that will allow the <strong>National Securities Market Commission (NSMC)</strong> to monitor advertising on investment in digital assets.</p>
<p style="text-align: justify;">As soon as the reform is applicable, the <strong>NSMC</strong> <strong>may authorize</strong> or <strong>ban</strong> any advertising on investment in <strong>crypto assets.</strong></p>
<p style="text-align: justify;">A capacity that will also be applicable for campaigns formulated from institutions that are not under the umbrella of their direct supervision, which includes the vast majority of bitcoin trading platforms and others that operate in Spain.</p>
<p style="text-align: justify;">All this occurs at a time when <strong>Europe</strong> is waiting for a regulatory framework that defines all the rules related to cryptocurrencies in general. <strong>Brussels</strong> is currently negotiating a<strong> set of rules</strong> known by the acronym <strong>MiCa.</strong></p>
<p style="text-align: justify;">At the moment, the <strong>only regulation</strong> that had been formulated on crypto assets in <strong>Spain</strong> was on their taxation, a measure with which the Government hopes to avoid fraud and collect about <strong>40 million euros</strong>.</p>
