<p style="text-align: justify;">The argument was accepted by the legal expert, who stated that “TikTok and YouTube prevent Meta from monopolizing the social media market.” He also referred to the changes that have occurred in the <strong>social media sector</strong> since the Commission filed the case, mentioning the <strong>generation of content with AI,</strong> which weakened the agency&#8217;s arguments.</p>
<p style="text-align: justify;">The ruling in favor of Meta is<strong> also a victory for Silicon Valley,</strong> “as <strong>US regulators</strong> increasingly seek to curb the power of Big Tech” such as Google, Apple, and Amazon.</p>

<p style="text-align: justify;">TikTok is accused of <strong>allowing minors to create accounts and browse its social network,</strong> “frequented by 170 million people in the United States.” <strong>Data collection has been sustained since 2019;</strong> likewise, the information has been stored without parental knowledge or authorization, even in the case of accounts created in Kids Mode.</p>
<p style="text-align: justify;">Deputy Attorney General Brian Boynton indicated that the fine is a necessary action to <strong>prevent minors under 13 from using regular TikTok.</strong> He warned that the defendants, “who are repeat offenders and operate on a large scale, must be prevented from <strong>collecting and using private data of young children without parental consent or control.”</strong></p>
<p style="text-align: justify;">It was learned that in June, the United States Consumer Protection Agency (FTC) presented a report to the Department of Justice in June regarding suspicions o<strong>f violation of the law by TikTok and ByteDance.</strong></p>
<p style="text-align: justify;">TikTok spokespersons have regretted the measure, and have indicated that they are accused of past practices, which have already been corrected. They noted that they are disappointed that the Department of Justice chose the fine instead of continuing to <strong>work together to find a reasonable solution.</strong></p>

<p style="text-align: justify;">At the end of June, <strong>Judge James Boasberg of the District of Columbia Court</strong> determined that the allegations against the social network presented by the FTC were <strong>&#8220;insufficient&#8221;</strong>, so he dismissed his claim, noting that the federal agency had not alleged sufficient facts to plausibly establish that Facebook has <strong>monopoly power</strong> in the market for personal social networking services.</p>
<p style="text-align: justify;">However, the judge gave the FTC <strong>30 days</strong> to amend his <strong>claim and resubmit a lawsuit</strong>, a deadline that was later extended until <strong>August</strong> <strong>19.</strong></p>
<p style="text-align: justify;">In the amendment to its claim, the FTC accuses the network that,<strong> lacking serious competitive threats</strong>, the company &#8220;has been able to perfect an advertising model based on surveillance and impose increasing burdens on its users.&#8221;</p>
<p style="text-align: justify;">&#8220;Facebook lacked the business acumen and technical talent to survive the transition to <strong>mobile devices and unable to compete with new innovators</strong>, Facebook illegally bought or buried them when their popularity became an existential threat&#8221;, said <strong>Holly Vedova</strong>, Acting Director of the FTC Competition Office.</p>
