The reason for this appearance was to discuss possible conflicts of interest with their lawyers.

According to a February 21 report by the Inner City Press, Bankman-Fried waived his right to legal representation without conflict of interest with lawyers Marc Mukasey and Torrey Young. These two attorneys also represent former Celsius CEO Alex Mashinsky, who took a similar action at a February 20 hearing.

The appearance before the United States District Court for the Southern District of New York marked one of the first times Bankman-Fried had been seen outside of prison since a jury convicted him on seven felony counts in November 2023. Although SBF’s life behind bars has been largely out of the media spotlight, photos were posted on February 19 showing the former FTX CEO with other inmates.

According to the Inner City Press, Mukasey and Young will continue to represent SBF and Mashinsky. In contrast, attorneys Christian Everdell and Mark Cohen, who represented Bankman-Fried in his criminal trial in October 2023, will retire. Bankman-Fried’s sentencing is scheduled for March 28 before Judge Lewis Kaplan.

Bankman-Fried, once regarded by many as the ‘golden child of the crypto space’, resigned as CEO of FTX in November 2022. The firm filed for bankruptcy, and SBF was detained in the Bahamas pending extradition to the U.S., where he was later charged and convicted of fraud related to the handling of funds between FTX and Alameda Research.

After his trial in October 2023, SBF was initially expected to face five additional felony charges in March. However, reports in December suggested that prosecutors did not plan to proceed with the second trial, citing public interest.

The U.S. Court of Appeals for the District of Columbia Circuit noted that Trump’s claim of immunity from criminal responsibility for his actions in the White House lacks backing in precedent, history, or the Constitution.

This ruling represents a major legal setback for Trump, 77, who is considered a favorite for the Republican presidential nomination in 2024. A spokesman for the former Republican president announced that they will appeal the decision “to safeguard the Presidency and the Constitution.”

“If a president is not guaranteed immunity, any future ruler will face immediate charges from the opposition party,” said Steven Cheung after hearing the appeal court’s decision. “Without full immunity, a president of the United States could not properly perform his role!” he added.

The appeals court suspended the immunity decision until next Monday, giving Trump the opportunity to appeal to the U.S. Supreme Court. The latter court decides whether to accept the case or uphold the judgement of the Court of Appeal.

Trump’s trial, scheduled for March 4 for conspiracy to overturn the 2020 election results won by Democrat Joe Biden, was postponed by the district judge in charge of the case, who was awaiting a ruling on the immunity issue by the appeals court.

District Judge Tanya Chutkan, who will preside over Trump’s election interference trial, rejected the immunity claim in December. In the past month, the three judges who heard the appeal were also unconvinced by the arguments presented by Trump.

In a statement, her defense indicated that for now she has not received formal notification of the complaint, but rather that she was known before by the media, which in her opinion shows “the media and reputational pressure to which she is subjected.”

In the same sense, she recalled that “as is publicly known, and as the Spanish Treasury was officially notified, Shakira has been living in Miami for a few months, so she must be notified personally at her new address.”

The judge in charge of the case considered that this measure was not necessary, since no evidence was found that the CEO of Binance or any member of the organization had transferred assets from the platform outside the United States.

The judge, Amy Berman Jackson, argued that the parties involved can enter into negotiations and collaborate while the investigations are carried out. Furthermore, no evidence was found that Changpeng Zhao or any Binance.US member transferred assets out of the country.

During the process, there was also a debate about whether certain cryptocurrencies should be classified as securities. The judge expressed her uncertainty as to whether these cryptocurrencies fit into the category of securities or whether they are considered commodities.

The Federal Court in Washington, DC, officially rejected the United States Securities and Exchange Commission (SEC) request to freeze the assets of Binance.US. This decision allows the exchange to continue operating in the country.

Judge Berman asked Binance.US to file a balance sheet of its trading assets and expenses with the court, also urging both the exchange and the regulator to continue negotiating to establish fair terms. According to reports, it is expected that there will be more details about this resolution next Thursday, June 15.

Judge Berman disagreed with her request to freeze the funds, criticizing SEC lawyers for trying to apply this measure without solid evidence that Binance CEO Changpeng Zhao or a member of the organization moved the funds. assets. She even directly questioned whether the SEC had determined movements of Binance.US funds out of the United States.

The legal confrontation between the two brands began in January 2020, when the speaker manufacturer filed a lawsuit in the United States against Google for infringement of its patents, assuring that it was done improperly.

Specifically, Google would have misused its technology and software in Sonos products after the two signed a collaboration agreement in 2013 to introduce services such as Google Play Music to these speakers. Specifically, this lawsuit against Google covered five patents.

Following its review, the ITC determined in January 2022 that Google must make the necessary and pre-approved software changes to unblock its products manufactured outside the United States and imported for sale in the United States, in order to prevent its Products are detained at customs.

In August of that same year, it was Google that countersued the sound equipment maker, with two complaints alleging that it had infringed seven of its patents related to its smart speakers and voice control technology.

So, the creator of services like Drive and Gmail filed the lawsuits with the United States District Court for the Northern District of California; a trial that began in early May and has recently concluded.

Their “rights to defense” were allegedly and confiscated more than 1,600 mining equipment by the National Superintendency of Crypto Assets and Related Activities (Sunacrip).

The action turned the court’s decision into a new precedent. The mining company filed the amparo appeal for the annulment of the confiscation of the equipment, claiming that the process carried out by Sunacrip presented irregularities, since the regulator did not explain the causes of the confiscation, nor did it offer them information about the location. of the confiscated equipment. In addition to preventing them from “collecting the necessary documents within the deadlines established by law”, violating property and “economic freedom.”

Return of confiscated equipment

The Caracas court evaluated the evidence and arguments presented by the defense attorneys of the mining company and agreed to issue a judgment annulling the confiscation of the “12 Antminer S9-S9I equipment, 1,624 EBANG E9I miners and 1,475 sources of power” that must return in its entirety to Sierramoros CA, in accordance with the provisions of the amparo accepted by the Caracas court.

However, the court also established, as part of its decision, to carry out another investigation that would allow to verify that the company has the permission and requirements indicated by Venezuelan laws for the execution of activities related to the mining of crypto assets.

On the other hand, this fact shows that Sunacrip is not the only institution that has power to regulate the crypto sector in Venezuela. So, if any company considers that its rights are being violated, it can go to the country’s courts and request the protection conceived within the laws of Venezuela.

The General Court of the European Union (TEU) confirmed the fine of 2.42 billion euros imposed by the European Commission on the technology multinational Google for abuse of a dominant position through its price comparison service, Google Shopping.

Specifically, the Luxembourg court dismissed the appeal that the company had filed for the sanction adopted in 2017. The sentence, however, can be appealed before the Court of Justice, the highest instance of European Justice.

“The General Court dismisses most of the appeal filed by the company and confirms the fine imposed by the European Commission“, the court said in a statement.

The entity confirms the amount of the fine imposed by Brussels. Among the reasons it provides to justify this decision, the judges highlight the “particularly serious” nature of the offense and the fact that the conduct was carried out in a “deliberate, not negligent” manner.

The judicial entity determined that the plaintiffs did not sufficiently demonstrate that their fundamental rights were violated, therefore it dismissed the complaints.

The objective of the European Union (EU) unitary patent is to reduce the time and cost of registering an invention by allowing each patent applicant to file a single application for a unitary effect in a centralized way, without the need to validate it in each country of the block.

The EU unitary patent is expected to reduce the cost of registering an invention by as much as 32,000 euros ($ 39,000), according to figures from the European Commission.

Now there is nothing to prevent the President of Germany, Frank-Walter Steinmeier, from promulgating the law approving the European unitary patent, which has already been approved by the Bundestag and the Bundesrat (Lower House and Upper House of Parliament, respectively) at the end of 2020.

With the unblocking of the project by Germany, which did not grant its consent for years due to unconstitutional appeals preceding the complaints dismissed today, the establishment of the Unified Patent Court, whose headquarters will be in Luxembourg, can proceed.

Judge James Boasberg determined that there was insufficient evidence to continue to accuse the company of abusing its market power.

Judge Boasberg, in his brief, states that the lawsuit filed by the government and the coalition did not have the arguments that will determine the action against what is established by law by the technology company.

However, the accusing party will have thirty days to modify the claim and present it again to the judge, if it considers it pertinent.

As it will be recalled, last December 2020, the president of the United States Republic for that moment, Donald Trump, through the Federal Trade Commission (FTC) and a coalition made up of 46 states, accused formally to the tech company Facebook for violating antitrust laws.

If the federal and fiscal regulators of the states that made up the coalition can verify the monopolistic practices of the social network, the court could force Mark Zuckerberg to sell the other two social networks: Instagram and WhatsApp.

After the legal conflict that Ripple is going through due to the lawsuit of the US Securities and Exchange Commission (SEC), Uphold’s position will remain favorable to the cryptocurrency XRP.

The cryptocurrency exchange operator and payment processor, Uphold, assures that until there is a legal justification from the Court on the charges of the SEC, it will not eliminate the digital asset, much less suspend its trading.

The company’s CEO, J.P. Thieriot, confirmed his position in a message posted on his Twitter account where he assures that Uphold “has decided to continue listing XRP unless the SEC complaint against Ripple is adjudicated to legally determine that XRP is currently a security or until the volume trading dissipates to a point where we can no longer support XRP. “

In addition, the company expressed the need to wait for a final judgment from the Court instead of making hasty and unjustified conclusions; therefore, he hopes other exchanges will take a similar stance on the matter rather than “go to trial before the court’s decision.”

For the exchange, the SEC’s decision could generate huge losses, leaving consumers without protection, “it is difficult to see how a lawsuit that makes XRP essentially useless and could make retail investors lose billions of dollars. who bought XRP in good faith would fit that mandate. We are still waiting for a sensible resolution, “Uphold said.
