The European Commission has announced that iMessage, Apple’s messaging service, and Bing, Microsoft’s search engine, will not be subject to stricter regulation under digital platform regulations.

In addition, two additional Microsoft products, the Edge browser and the Microsoft Advertising advertising system, also benefit from this exemption.

The new EU platform law stipulates that large companies, known as gatekeepers, will be subject to stricter regulatory rules. However, these two specific Microsoft products are excluded from that regulation.

The list of companies identified as “gatekeepers” by the European Commission includes Apple, Microsoft, Alphabet (Google’s parent company), Amazon, ByteDance (TikTok) and Meta (Facebook). These companies are subject to stricter rules.

The complete list includes four social networks (TikTok, Instagram, Facebook and LinkedIn), two messaging systems (WhatsApp and Messenger), three operating systems (Android, iOS and Windows), the Google search engine and the Chrome and Safari browsers.

The Commission announced that it had closed four ongoing investigations into these services.

Both Apple and Microsoft have praised the Commission’s decision. An Apple spokesperson said: “We thank the Commission for agreeing with us that iMessage should not be designated under the Digital Markets Act (DMA).”

For its part, a Microsoft spokesperson said the company will continue to “work with the Commission and the industry at large to ensure that Microsoft’s other designated platforms are fully compliant with the MDL”.

The Digital Markets Law establishes new rules for technology companies, especially those like Meta, Apple or Google, which are considered controllers or gatekeepers of the market, for which they must assume a series of obligations and prohibitions that guarantee fair competition in the digital sector.

To this end, the law provides that digital companies considered gatekeepers have responsibilities such as sharing their data, including links in their services that take users to other competitors in the sector, and making their services interoperable with other applications from rival companies.

Likewise, as detailed by the European Commission, for a company within the digital market to be included in the scope of application of the standard, it must have a turnover of more than 7,500 million euros in annual turnover, a higher market capitalization to 75,000 million euros and, at least, 45 million monthly active users in the European Union.

In other words, according to these parameters, companies such as Apple, Microsoft, Google, Meta, Amazon or ByteDance are considered gatekeepers and must adapt their services in accordance with the DMA restrictions.
