<p style="text-align: justify;">The new bill, called the <strong>Crypto Asset Market Clarity Act,</strong> was sponsored by the Chairman of the Agriculture Committee, Republican John Boozman, and Democrat Cory Booker.</p>
<p style="text-align: justify;">With the proposal, the Senate seeks to define “which digital assets should fall under the purview of the <strong>Commodity Futures Commission (CFTC)</strong> and which will remain under the jurisdiction of the <strong>Securities and Exchange Commission (SEC).”</strong></p>
<p style="text-align: justify;">With the approval of this proposal, <strong>the category of “fungible digital assets” would be introduced</strong> into the regulations already under discussion. This category <strong>encompasses blockchain-based crypto assets</strong> that allow direct transfers between users without intermediaries. This definition<strong> excludes stablecoins, NFTs, and tokens of a speculative or humorous nature.</strong></p>
<p style="text-align: justify;">Key aspects of the bill include <strong>mandatory registration for cryptocurrency brokers, exchanges, and custodians;</strong> regulations against market manipulation, protection of client funds, and cybersecurity protocols; the appointment of a <strong>compliance officer responsible for fraud prevention; and exceptions for software developers and self-custody wallets.</strong></p>
<p style="text-align: justify;">If approved, the new law will establish <strong>an 18-month period for the CFTC to draft the final regulations,</strong> as well as a transition period for platforms to adapt.</p>

<p style="text-align: justify;">According to local media outlet <em>MoneyToday</em> on Monday, August 18, <strong>&#8220;the Financial Services Commission (FSC) will unveil the bill as part of the second phase of the country&#8217;s Virtual Asset User Protection Act.&#8221;</strong></p>
<p style="text-align: justify;">In this regard, Representative Park Min-kyu of the Democratic Party of Korea (DPK) noted that <strong>the FSC issued a report “on the policy direction for stablecoins”</strong> and the <strong>government bill</strong> is expected to be submitted to the <strong>National Assembly in October.</strong></p>
<p style="text-align: justify;">This legal instrument should establish<strong> “the requirements for issuance, collateral management, and internal control systems for stablecoins.”</strong></p>
<p style="text-align: justify;">The Asian country is also <strong>seeking to reduce dependence on dollar-pegged stablecoins by issuing a won-backed stablecoin.</strong> The idea has been in the works since 2023. Recently, <strong>“several lawmakers have since submitted related proposals, including the Digital Asset Basic Law by Representative Min Byung-deok of the Democratic Party,</strong> the <strong>Act on the Issuance and Circulation of Stable Value Digital Assets</strong> by Representative Ahn Do-gul of the Planning and Finance Committee, and the<strong> Payment Innovation Act Using Value-Pegged Digital Assets</strong> by Representative Kim Eun-hye of the People&#8217;s Power Party.”</p>

<p style="text-align: justify;">In this regard, the country is preparing <strong>a tax system similar to that of other investment assets to ensure tax equity and avoid distortions in the market.</strong> “A transition period is being considered for those investors who cannot document the acquisition of their digital assets, facilitating their incorporation into the new legal framework.”</p>
<p style="text-align: justify;">On the other hand, the government rules out<strong> “tax benefits or special incentives for companies and individuals operating with cryptocurrencies,”</strong> since, according to international experts, this could translate into a <strong>disproportionate tax burden</strong> for traditional industries.</p>
<p style="text-align: justify;">Currently, the <strong>National Securities and Exchange Commission is the entity designated to supervise the cryptocurrency</strong> <strong>market.</strong> However, it does not have the necessary institutional capacity. Therefore, the government is studying the possibility that the <strong>National Bank of Ukraine will temporarily take on this responsibility,</strong> “guaranteeing effective supervision and the protection of investors.”</p>
<p style="text-align: justify;">Necessary measures will be taken to <strong>prevent crimes such as money laundering and other illegal activities,</strong> promoting an <strong>investment-friendly environment.</strong></p>

<p style="text-align: justify;">According to <strong>U.S. health authorities,</strong> “users who browse social media for more than three hours a day “are exposed to a double risk of experiencing mental health problems.”</p>
<p style="text-align: justify;">Attorney General Bonta’s bill, known as AB 56, is supported by Assemblywoman Rebecca Bauer-Kahan. Both have referred that <strong>“subscribers, especially children and adolescents, should have access to clear information about the harmful effects</strong> that can be caused by the use of social media services. They suggest that companies such as <strong>Meta, Snap, ByteDance or X</strong> should show notices to users of all ages when they log in for the first time.”</p>
<p style="text-align: justify;">Then, the sending of these <strong>notifications should be weekly, remain on screen for at least 90 seconds and cannot be skipped.</strong></p>
<p style="text-align: justify;">The legal tool is based on the provisions provided for in the <strong>laws of Protection against Cyberbullying and Prevention of Online Violence,</strong> which are in force in the state of California.</p>
<p style="text-align: justify;">Among the provisions is the obligation for social networks to “inform about their protocols to avoid, detect and contain cyberbullying and the dissemination of violent materials.”</p>
<p style="text-align: justify;">The bill addresses the problem of addiction to social networks among minors in particular. In this regard, it is appropriate to remember that in the <strong>United States the minimum age to use these digital communication spaces is 13 years old. Despite this, nearly 40% of children between 8 and 12 years old are members of one of these platforms.</strong></p>
<p style="text-align: justify;">“Vivek Murthy, the director general of public health in the United States, said at the beginning of the year that <strong>big tech should adopt a labeling system</strong> to warn about its possible negative effects on psychological well-being. The proposal was presented to Congress and supported by 42 attorneys general, including Bonta.”</p>

<p style="text-align: justify;">The proposal was made by <strong>Labour MP Josh MacAlister</strong>, who argued that the goal is to <strong>“protect children </strong>from excessive use of mobile devices and <strong>social networks</strong>, which are often <strong>addictive by design.”</strong></p>
<p style="text-align: justify;">The new regulation called “Safer Phones,” presented last week in the European country, “highlights that <strong>social media platforms must exclude teenagers from recommended content algorithms,</strong> a measure that aims to limit their exposure to addictive content.”</p>
<p style="text-align: justify;">MacAlister stressed that the bill would raise the minimum age for Internet access from 13 to 16 years, with the requirement of parental approval “so that <strong>technology companies can access the data of minors.”</strong></p>
<p style="text-align: justify;">As long as the companies behind <strong>social networks cannot use the data of teenagers</strong> in their recommendation algorithms, it will be more difficult to show them addictive content.</p>
<p style="text-align: justify;">On the other hand, the independent British communications body <strong>Ofcom</strong> will monitor the application of user age verification so that minors are not exposed to <strong>applications designed to be addictive.</strong></p>
<p style="text-align: justify;">It is important to highlight that<strong> the bill “includes prohibiting the use of telephones in educational centers, turning them into mobile phone-free zones</strong> to improve the concentration of students.”</p>
<p style="text-align: justify;">On the other hand, it is expected that the country&#8217;s <strong>authorities will implement “stricter regulations</strong> on the design, supply, marketing and use of smartphones for minors under 16 years of age” in favor of the mental health of young people.</p>

<h2>Bitcoin at risk in Costa Rica</h2>
<p style="text-align: justify;">In the case of Costa Rica, according to <em>Cointelegraph</em>, r<strong>epresentative Johana Obando Bonilla</strong> has highlighted the introduction two years ago in the <strong>National Assembly</strong> of a comprehensive bill to legitimize the use of <strong>cryptocurrencies in the country.</strong></p>
<p style="text-align: justify;">Recently, discussions have advanced about limiting the ability of Costa Ricans to <strong>freely use cryptocurrency as a means of payment for daily transactions.</strong></p>
<p style="text-align: justify;">The controls would be focused on aspects such as “the integration of <strong>standard know-your-customer (KYC) and anti-money laundering (AML)</strong> controls by companies in the sector.”</p>
<p style="text-align: justify;">Although Congresswoman Obando has emphasized the need for a <strong>legal framework</strong> that provides security and prevents money laundering, she has also warned that the new <strong>regulation</strong> could encourage the emergence of a clandestine market.</p>
<p style="text-align: justify;">The Central American country seeks to establish the rules “for the exercise of activities related to the new class of assets”, as well as the<strong> “guidelines for the use and taxation of mining, marketing, custody, payments and other activities with digital currencies.”</strong></p>
<h3 style="text-align: justify;">Paraguay wants to limit bitcoin mining</h3>
<p style="text-align: justify;">Authorities in the country are weighing the <strong>consumption of electrical energy from BTC mining and how it affects the service to the population.</strong> In this sense, on April 4, legislators introduced a bill arguing that bitcoin mining steals energy and interrupts electrical service.</p>
<p style="text-align: justify;">Although the restriction could cause <strong>the country to lose more than USD 200 million annually,</strong> if approved “it will last 180 days or until new laws are enacted and the national <strong>electricity grid operator</strong> can guarantee that it supplies enough energy.”</p>
<p style="text-align: justify;">According to <strong>Hashlabs Mining co-founder and chief mining strategist Jaran Mellerud,</strong> “banning bitcoin mining <strong>could cost Paraguay more than $200 million a year,</strong> assuming the country has 500 megawatts of legal miners paying $0.05 per kilowatt-hour in operating expenses.”</p>
<p style="text-align: justify;">Regarding electricity consumption, it is alleged that the<strong> Itaipú dam</strong> is the favorite place for mining, &#8220;since it supplies all of Paraguay&#8217;s local electricity needs and leaves a large <strong>surplus that can be used.&#8221;</strong></p>
<p style="text-align: justify;">In fact, the surplus produced by the dam <strong>“has been exported to Brazil</strong> at low prices. However, Mellerud noted that a wave of bitcoin miners has flocked to such electricity, paying slightly higher prices in recent months.</p>
<p style="text-align: justify;">The legislators argue that since February, they have counted <strong>50 electricity supply interruptions related to the illegal exploitation of these sources of electricity for BTC mining.</strong> On the subject, the National Electricity Administration of Paraguay “estimates that each cryptocurrency mining operation has caused damage and losses of up to USD 94,900 and that the total annual losses in the Alto Paraná area – where the Itaipú power plant is located – could amount to <strong>USD 60 million.”</strong></p>
