<p style="text-align: justify;">Now, the city of New York joins this initiative by prohibiting the use and installation of <strong>TikTok</strong> on <strong>city-owned devices</strong> with immediate effect.</p>
<p style="text-align: justify;">In this sense, the directive issued on Wednesday details that, after a review by the New York City Cyber Command, it was concluded that TikTok &#8220;<strong>represents a security threat to the city&#8217;s technical networks</strong>&#8220;. Likewise, it was detailed that this Command &#8220;regularly explores and promotes proactive measures to keep New Yorkers&#8217; data safe.&#8221;</p>
<p style="text-align: justify;">According to statements by a spokesman for the <strong>New York City Council,</strong> included in said statement, this decision is intended to guarantee the safety of New York citizens and the protection of their data. &#8220;While social media is great for connecting New Yorkers with each other and with the city, we must ensure that we always use these platforms safely,&#8221; the spokesperson added.</p>

<p style="text-align: justify;">However, it is important to mention that this prohibition does not affect securities and other financial instruments that are regulated by the <strong>Central Bank of Kuwait</strong> and the CMA itself, which are excluded from this restrictive measure.</p>
<p style="text-align: justify;">The CMA warns customers about the risks associated with <strong>cryptocurrencies,</strong> noting that they have no legal status and lack the backing of any official entity. Furthermore, since they are not tied to any asset or issuer, their prices are often driven by speculation, making them highly volatile and prone to significant falls.</p>
<p style="text-align: justify;">The issued circular also highlights that the penalties for violating Kuwait&#8217;s <strong>anti-money laundering</strong> laws are clearly stipulated in<strong> Article 15 of Law No. 106 of 2013</strong>, and are expected to be rigorously enforced.</p>
<p style="text-align: justify;">This ban marks a significant shift in <strong>Kuwait&#8217;s position regarding cryptocurrencies</strong> and shows the growing concern of financial authorities about the potential impact of these virtual currencies on the <strong>country&#8217;s economic stability.</strong> From now on, citizens and companies must comply with this <strong>new regulation</strong> to avoid facing the established sanctions.</p>

<p style="text-align: justify;">The agency floated the idea of a &#8220;new category&#8221; of cross-border payment platform with a single registry. According to the report, <strong>Brazil, Argentina, Colombia</strong> and <strong>Ecuador,</strong> whose governments are in the process of regulating cryptocurrencies, are among the countries with the highest rates of adoption of digital assets in an effort to help the unbanked, streamline payments and reduce costs, among other benefits.</p>
<p style="text-align: justify;">The IMF stated: &#8220;If designed well, CBDCs can strengthen the usability, resilience, and efficiency of payment systems, and promote financial inclusion in Latin America and the Caribbean. Although some countries have chosen to ban cryptocurrencies entirely due to Due to its risks, this approach may not be effective in the long term.Instead, the region should focus on addressing the drivers of demand for cryptocurrencies, such as the unmet needs of citizens for <strong>digital payments,</strong> and improving transparency through registration of crypto asset transactions in national statistics&#8221;.</p>

The legal text includes a section dedicated to <strong>promotion prohibitions,</strong> and which specifies that influencers cannot exercise &#8220;the activity of commercial influence by electronic means&#8221;, &#8220;directly or indirectly&#8221;, when they endanger the p<strong>rotection of health public through the promulgation of information on aesthetic,</strong> pharmacological and <strong>surgical techniques,</strong> methods and treatments.</p>
<p style="text-align: justify;">On the other hand, with this new law, <strong>influencers will not be able to promote</strong> products that can be consumed or contain, even partially, <strong>nicotine,</strong> nor will they have the right to issue therapeutic prescriptions.</p>
<h2 style="text-align: justify;">France demands transparency in publications</h2>
<p style="text-align: justify;">This regulation also clarifies that it is prohibited for people who exercise commercial influence activity by electronic means to <strong>directly or indirectly</strong> promote financial products and services, including those <strong>related to digital assets.</strong></p>
<p style="text-align: justify;">Hence, it is also <strong>illegal</strong> to <strong>invite other users to establish a relationship</strong> with them through a contact form or request additional information to carry out operations related to <strong>cryptocurrencies.</strong></p>
<h3 style="text-align: justify;">Penalties include fines and jail time</h3>
<p style="text-align: justify;">This law determines, finally, that in case of committing an infraction with the provisions of it, these users may receive <strong>fines of up to 300,000 euros and two years in prison</strong> in case of carrying out deceptive commercial practices.</p>
<p style="text-align: justify;">From now on, influencers will also be penalized if they promote false health services, alcoholic beverages, <strong>financial services, sports betting and gambling on their profiles, with fines of up to 100,000 euros.</strong></p>
<p style="text-align: justify;">In this case, <strong>they can also be prohibited from carrying out their activity,</strong> either temporarily or permanently, in addition to being denied access to these &#8216;online&#8217; platforms.</p>
<p style="text-align: justify;">On the other hand, if these content creators do not introduce a label that reflects that a filter has been used or their photos and videos have been retouched, they would receive a <strong>fine of up to 37,500 euros.</strong></p>
<p style="text-align: justify;">Finally, this Ministry has commented that a <strong>guide to good practices</strong> for influencers has been drawn up, which integrates their fiscal, social and regulatory rights and obligations.</p>
